Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Plant-Maxxing web and iOS application, including any related services we provide (together, the "Service"). The Service is operated by Spot Cloud B.V., a company registered in the Netherlands ("Spot Cloud", "we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms.
01Acceptance of the Terms
By signing up, signing in, browsing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Service immediately. If you are accepting these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.
02Eligibility
You must be at least 16 years old to use the Service. If you are between 16 and 18, you confirm that your legal guardian has reviewed and accepts these Terms on your behalf. We do not knowingly allow anyone under 16 to create an account, and accounts suspected of belonging to an underage user may be removed.
03Account & sign-in
To use most features you must create an account. You can sign in through a third-party single sign-on provider (Apple, Google, Microsoft, or Discord) or with an email address and one-time code. When you use a sign-in provider, you authenticate with that provider and we receive only the information needed to operate your account, such as your email address and, where applicable, a display name.
You are responsible for keeping your sign-in credentials and devices secure and for all activity under your account. If you believe your account has been compromised, contact us promptly. We may require additional verification before granting access to an account.
04The Service
Plant-Maxxing is a free application that estimates the protein completeness of meals, primarily those based on plant-based ingredients, from a photo or text input. It shows amino-acid breakdowns, keeps a meal log and trends over time, generates weekly menu suggestions, and offers an AI coach chatbot that can answer questions in the context of your account.
We provide the Service free of charge. We may introduce paid features, partnerships, or other offerings in the future, and we may change, suspend, or discontinue any part of the Service at any time, including features, scoring models, supported regions, or availability on particular platforms. We will not change these Terms or your core data-deletion rights without notice as described below.
05Acceptable use
You agree to use the Service lawfully and respectfully. You will not, and will not assist anyone else to:
- use the Service in any manner that could damage, disable, overload, or impair it, or interfere with any other party's use;
- attempt to gain unauthorised access to any part of the Service, its systems, or another user's account;
- scrape, crawl, index, mirror, or otherwise systematically extract data, scores, images, or content from the Service, except as explicitly permitted by the Service's features;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, scoring models, prompts, or underlying algorithms of the Service;
- resell, sublicense, repackage, or redistribute access to the Service, or build a competing product primarily using its outputs;
- submit content that is unlawful, infringing, defamatory, harmful, deceptive, or otherwise objectionable, or that violates the rights of any third party;
- use the Service to harass others, send unsolicited communications, or process data on behalf of others without a lawful basis;
- use automated scripts, bots, or rate-abuse techniques to exceed intended usage limits, except where we have expressly permitted it.
You are solely responsible for the inputs you submit and for how you act on any output the Service provides.
06User content
You retain ownership of any meal photos, text descriptions, notes, preferences, coach messages, and other materials you submit through the Service ("User Content"). By submitting User Content, you grant Spot Cloud a worldwide, non-exclusive, royalty-free, fully-paid licence to host, store, transmit, display, reproduce, and otherwise use your User Content solely to the extent necessary to operate, secure, maintain, and improve the Service for you and other users, including running our scoring engine and generating coach and menu outputs.
You represent that you have the rights to submit your User Content and that doing so does not violate applicable law or third-party rights. We do not claim ownership of your User Content. Nothing in these Terms gives us the right to use your User Content for advertising, to train standalone commercial models sold to third parties, or for any purpose unrelated to the Service, except where required for security, legal compliance, or to prevent harm.
07Intellectual property
The Service, including the Plant-Maxxing name and branding, the user interface, the protein-scoring engine, amino-acid reference data, menu generation logic, coach behaviour, and all related software and documentation, are owned by Spot Cloud and protected by applicable intellectual-property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
Feedback, suggestions, or ideas you voluntarily provide about the Service may be used by us without restriction or compensation, unless you explicitly mark them as confidential. We encourage you not to send confidential information.
08Not medical or nutritional advice
Plant-Maxxing provides general information about meals and estimates of protein and amino-acid content. These outputs are generated from photos, text, and reference data using automated models. They are approximations, may be inaccurate, and can vary significantly depending on portion size, ingredient identification, brand differences, and preparation method.
The Service is not a medical device, and it does not provide medical, clinical, dietary, or nutritional advice, diagnosis, or treatment. It is not a substitute for professional advice from a qualified physician, registered dietitian, or other licensed professional. Do not rely on the Service to make decisions about pregnancy, breastfeeding, infant or child feeding, eating disorders, allergies, medical conditions, or any treatment plan. Always seek guidance from a qualified professional for your individual circumstances.
09No warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, Spot Cloud disclaims all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranty that the Service will be uninterrupted, error-free, accurate, secure, or that any particular result will be achieved.
We do not warrant that the protein scores, amino-acid estimates, menu suggestions, or coach responses are correct, complete, or suitable for any purpose.
10Limitation of liability
To the maximum extent permitted by applicable law, in no event will Spot Cloud, its directors, employees, affiliates, or service providers be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or health outcomes, arising out of or related to your use of, or inability to use, the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Because the Service is provided free of charge, our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed fifty euros (EUR 50), or, if greater, the total amount you have paid us in the twelve months preceding the event giving rise to the claim, which is currently zero. This limitation applies even if a remedy fails of its essential purpose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for wilful misconduct or fraud.
11Indemnity
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Spot Cloud and its directors, employees, affiliates, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your User Content; (b) your violation of these Terms; (c) your violation of applicable law or third-party rights; or (d) your misuse of the Service. We reserve the right to assume the exclusive defence of any matter subject to indemnification by you, in which case you will cooperate with us as reasonably requested.
12Suspension & termination
You can stop using the Service at any time. To delete your account and erase your data, open Profile → Delete account in the app; deletion is irreversible and removes your meal log, preferences, scores, coach memory, coach usage counters, and your subscription and entitlement records, as described in the Privacy Policy.
We may suspend, restrict, or terminate your access to the Service, or delete your account, at our sole discretion and without notice, if we reasonably believe you have violated these Terms, if your activity creates legal, technical, or security risk, if required by law, or if we discontinue a feature or the Service altogether. We have no obligation to retain your User Content after your account is closed.
Provisions that by their nature should survive termination — including ownership, intellectual property, the medical disclaimer, no-warranties, limitation of liability, indemnity, governing law, and contact — will remain in effect.
13Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before the new Terms take effect. The "Last updated" date at the top of this page indicates when these Terms were last revised. Continuing to use the Service after changes take effect means you accept the updated Terms. If you do not agree, you may delete your account as described above.
14Governing law & disputes
These Terms and any dispute arising out of or related to them or to the Service are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the competent courts of the Netherlands, without prejudice to any mandatory consumer rights you may have in the country where you reside.
Before filing a claim, you agree to contact us in good faith so we have a reasonable opportunity to resolve the matter. Nothing in these Terms affects your rights as a consumer under mandatory provisions of applicable law.
